By placing an order on the christelejacquemin.com Site for products that are sold on the site, it will be considered that you have read, understood and accepted these general conditions of sale of products online ("General Conditions of Sale"). Please read them carefully and, if you are not satisfied with their content, we advise you to contact us before placing any order.
We may make changes to these Terms of Sale at any time. To see when these Terms of Sale were last updated, please refer to the top of the page. Each time you order Products from us, the Terms of Sale in force at the date of the order will apply to the contract between you and us. If we need to change these Terms of Sale and this will significantly affect your order, we will contact you to tell you what the changes are in good time and how you can cancel the contract if you are not happy with them.

All sales on the christelejacquemin.com website are carried out by the sole proprietorship Christèle Jacquemin registered in the Nîmes Trades Directory under number 853.727.113 RM 30, VAT number FR44853727113, whose head office is located at 10 rue de la cabote 30190 Castelnau-Valence France.
Eligibility
To make a purchase through the Site or to use any of the services or features we make available to you on the Site, you will need to create an account. When you register, you will be required to provide us with information about yourself, including your name, telephone number and email address, which must be accurate, current and complete in all respects. If the information provided during your registration changes, you must immediately update your online account. We may make changes to the registration requirements at any time. In addition, when placing an order, you will be required to provide bank details. You represent and warrant that the bank details provided in connection with any order are both valid and correct and that you are the person whose name appears on the billing documents submitted.
The purchase of products through the Site is strictly limited to persons who can legally enter into contracts on the Site in accordance with French law.
Pricing policy
The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of the Site. They will be your responsibility and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.
All orders, regardless of their origin, are payable in euros.
The Site reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in effect at the time of validation of the order and subject to availability.
The products remain the property of Christèle Jacquemin until full payment of the price.
Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
Availability
All products are offered subject to availability. The prices as shown on our Site will apply while the products are available or for any period stipulated on it. We will inform you as soon as possible if the products you have ordered are not available.
Order errors
You can correct any erroneous order as long as you have not clicked the "Place Order" button (or equivalent) on the last page of the order process.
Confirmation and acceptance of your order
We will send you an order confirmation by email as soon as possible, including an order number. If we are unable to fulfill your order after confirming it, we will notify you by email or telephone. We will confirm acceptance of your order by email, which will specify that the products have been shipped ("Shipping Confirmation"). If you would like information about your order, please write to us at the following address christele@christelejacquemin.com, specifying your order number. We may refuse your order if the product you wish to purchase is no longer in stock, if we have identified an error concerning an item or if we are unable to obtain authorization for your payment.
Payment
Validating your order implies for you the obligation to pay the indicated price. Payment for your purchases is made by credit card using the secure Stripe system. The card is debited at the time of the order.
Inspection
You must inspect the products upon receipt and check that everything stated on the delivery note is present. We will consider that you have accepted the order unless you notify us otherwise (and return the products to us in accordance with your right of withdrawal or any other legal right).
Withdrawal
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to provide reasons or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories). In this context, you are liable. Any damage suffered by the product on this occasion may be such as to invalidate the right of withdrawal.
In the event of exercising the right of withdrawal, the Site christelejacquemin.com will reimburse the sums paid, within 14 days following notification of your request and via the same means of payment as that used when ordering.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

The provision of services fully performed before the end of the withdrawal period and the performance of which began after the consumer's express prior agreement and express waiver of his right of withdrawal.

Delivery
The products are delivered to the delivery address indicated during the order process, within the time indicated on the order validation page.
In the event of a shipping delay, an email will be sent to you to inform you of any possible impact on the delivery time indicated to you.
In accordance with legal provisions, in the event of a delay in delivery, you have the option to cancel the order under the terms and conditions defined in Article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will refund it and cover the shipping costs under the conditions of Article L 138-3 of the Consumer Code.
In the event of deliveries by a carrier, the Site christelejacquemin.com cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several appointment proposals.
Guarantee
All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.
All claims, requests for exchange or refund must be made by email within 30 days of delivery.
The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, etc.). The shipping costs will be refunded to you on the basis of the invoiced rate and the return costs will be refunded to you upon presentation of supporting documents. The provisions of this article do not prevent you from benefiting from the right of withdrawal.
Responsibility
The products offered comply with current French legislation. Christèle Jacquemin cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products you plan to order.
Furthermore, Christèle Jacquemin cannot be held responsible for damage resulting from improper use of the product purchased.
Finally, Christèle Jacquemin cannot be held responsible for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, an external intrusion or the presence of computer viruses.
Applicable law in the event of disputes
The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
Intellectual property
All elements of the christelejacquemin.com Site are and remain the intellectual and exclusive property of Christèle Jacquemin. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written consent of Christèle Jacquemin.
Archiving Proof
Christèle Jacquemin will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
